What HProxy is, what we promise, and what you agree to — the contract between you and Obsidian UG when you use this service.
HProxy is a residential, mobile, ISP, and datacenter proxy service operated by Obsidian UG (haftungsbeschränkt). You buy bandwidth or static IP allocations and route HTTP / HTTPS / SOCKS5 traffic through them. Standard outbound proxy behaviour, no SDK required.
You must be at least 18 years old and legally capable of entering into a binding contract under German law. You must accurately represent yourself or the entity you are signing up on behalf of. One account per person or company; multi-accounting circumvents abuse limits and is grounds for suspension.
You are responsible for keeping your login credentials private. We recommend Google sign-in (no password to lose). Notify us immediately at [email protected] if you suspect unauthorised access. We are not liable for losses arising from credential mismanagement on your end.
HProxy is intended for legitimate business purposes: web scraping, ad verification, SEO research, brand protection, market intelligence, price monitoring, headless browser automation. If you can accomplish it from your home IP without breaking the destination site's terms, you can do it through HProxy.
You may not use HProxy for any of the following. Engaging in any of these is grounds for immediate suspension without refund:
You are solely responsible for complying with the terms of service, robots.txt directives, and rate limits of the destinations you scrape or interact with. HProxy provides infrastructure; the legal relationship with the destination is between you and them.
Most products are pay-as-you-go: you top up a wallet balance and consume it as you generate proxies or route bandwidth. Subscriptions exist for residential bandwidth at a discount, billed monthly. All prices are exclusive of applicable VAT, which is added at checkout.
We accept credit and debit cards, SEPA direct debit, and major cryptocurrencies, all handled through our PCI-DSS-compliant payment partners. For crypto payments above €1,000, basic identity verification may be required to comply with the Geldwäschegesetz (German Anti-Money-Laundering Act).
Wallet balance does NOT expire on the Standard and Basic residential tiers. The Survey tier explicitly expires unused balance after 30 days — that's the trade-off for its lower per-GB price. Static IP and mobile port allocations have explicit expiry dates shown at purchase.
See the dedicated refunds page for the full policy. Short version: a 14-day money-back guarantee on unused balance if the service doesn't work for your use case, alongside your statutory right of withdrawal.
You may cancel your account at any time from the dashboard. Subscription cancellations take effect at the end of the current billing period (no pro-rated refunds for partial months). Pay-as-you-go top-ups can be refunded per the refunds policy if unused.
We may suspend or terminate your account immediately and without refund if you violate the Acceptable Use Policy, engage in fraud, or fail to pay an invoice that has been due for more than 14 days. We may terminate with 30 days notice for any other reason at our discretion; in such cases unused balance is fully refunded.
As a consumer entering a distance contract, you have a statutory 14-day right of withdrawal under §355 BGB. You may withdraw without giving any reason, by a clear statement to [email protected]; the official model withdrawal form is available on request.
Proxies are digital content we activate for you immediately. Under §356 (5) BGB, your withdrawal right ends once we begin delivery — but only after you expressly request immediate activation and acknowledge that doing so ends the right, which you confirm at checkout. We promise to provide a working proxy service with reasonable infrastructure availability. We do not promise that any specific destination will be reachable, that any specific IP will work for any specific use case, or that the service will be uninterrupted. Proxies fail; that is the nature of the medium.
To the extent permitted by German law, our liability is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, lost-profit, or lost-data damages. This limitation does not apply to liability that cannot be limited under §309 No. 7 BGB (gross negligence, intent, injury to life / body / health, mandatory product liability).
We are not liable for failure to perform due to circumstances beyond our reasonable control: natural disasters, war, government action, internet backbone outages, sub-processor failures we could not anticipate, or pandemics restricting workforce availability.
These terms and any dispute arising from them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers (Verbraucher) habitually resident in another EU member state, the mandatory consumer-protection rules of that state remain unaffected.
For disputes with merchants (Kaufleute), legal entities under public law, or special funds under public law, the exclusive place of jurisdiction is Bad Oeynhausen, Germany. Consumers may always bring proceedings before the court of their habitual residence.
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full effect. The invalid provision is to be replaced by a valid one that comes closest to the economic intent of the original.
We may update these terms from time to time. Material changes — anything affecting your rights or obligations — are announced 30 days in advance by email. Continued use after the effective date constitutes acceptance. If you don’t agree, you may cancel your account before the effective date and receive a refund of any unused balance.
